Victim Rights and Responsibilities

You have the right to be notified of:

  • Arrest of the accused
  • Availability of victim service programs
  • Availability of compensation for victims of violent crimes
  • Any Court hearings where release of the accused will be considered
  • Release of the accused
  • Court proceedings during prosecution of the case
  • Motions for new trial or appeal dates
  • Parole or change in status of Defendant, if requested in writing

You have the right to:

  • Express your opinion on the release of the accused pending court proceedings
  • Express your view on the outcome of the case prior to plea negotiations or sentencing of the accused
  • Complete a Victim Impact Statement

Your responsibility:

In order for you to be notified of various proceedings you must provide the police with your correct address, home and work telephone numbers during your initial contact by the Police at the date of the incident. The Officer will provide you with a Victim Notification Supplemental Report to sign. This Supplemental Report is a three page carbon copy form that one page stays with the Police, one goes to the Jail and the other comes to our office.

If your phone number changes from the number you first gave police, you must notify the Floyd County Jail (706-291-4111, x 3) and the Victim Witness Assistance Program (706-233-0039) so if there is an arrest, you can be informed of criminal proceedings and the Defendant’s release from jail. If you have a mobile phone or a pager, please let the Victim Witness Office know since these numbers can be used at a later date for our office to get in touch with you. Also, please keep the District Attorney’s Office updated on all address changes. This should be done in person at the District Attorney’s Office with a photo ID.

If the Defendant (accused) is convicted and sent to prison and you want to be notified of parole information or you want to express your opinions prior to a parole decision, you must write to the State Board of Pardons and Paroles/Department of Corrections Victim Services. Also, if the Defendant is sentenced to prison and you want to know of any change in his/her status you must send a notification form to the Victim Services. Both of these forms can be found on the “Links” page of this website. An Advocate within the Victim Witness Office can assist you in filing out these forms.
